Possession of firearms or explosives in the home of an individual under guardianship is considered a safety risk. These items must be removed from the home. Before the removal, firearms or explosives should be cleared by law enforcement for safe transport.

Let’s take a look at the following scenario.

Scenario:

GSSW was notified while in court, on a scheduled case, that the judge was going to appoint the state on a different case that was being heard due to family conflict. GSSW found out from the judge, while in court being sworn in, that the GSSW needed to go out to the home to visit the individual being appointed a guardian and ensure the living arrangements were appropriate. Due to the family conflict that arose, the judge asked the deputy to escort GSSW for the home visit.

While at the home, GSSW discovered that the individual had a pistol in her bedroom that she kept locked in a closet. GSSW immediately stepped outside and called her supervisor to inform her that the pistol was discovered. GSSW was advised to talk with the individual under guardianship and explain that she can’t have firearms while under Guardianship. GSSW was further instructed to ask the deputy to clear the firearm of any ammunition and run a check to ensure it is legal. GSSW also talked with the individual under guardianship about whether there were any other firearms or explosives in the home, and there were not. Once the deputy cleared the gun of any ammunition and ran a check on the gun, GSSW asked if the deputy would hold on to the gun until the Guardianship trial was complete and it could be disposed of; the deputy agreed and took possession of the gun. The individual under guardianship did not like the situation but stated she understood.

GSSW consulted with her supervisor and reached out to Firearms dealers in the area to go ahead and set up a sale scheduled after the guardianship trial. After the guardianship trial, the individual under guardianship was found to be wholly disabled in both personal and financial affairs. GSSW contacted the deputy who met GSSW at the firearms dealer and brought the pistol on sight, where GSSW never had to handle the weapon. GSSW had the value of the weapon found at Blue Book of Gun Values, in which the dealer agreed to pay. GSSW received a copy of the receipt and the check payable to the individual under guardianship. Afterward, GSSW took the check, receipt, and a copy of the bluebook value to the admin specialist. The GSSW scanned a copy of all three documents into an event in KYGFIS and provided them to the admin specialist. The admin specialist mailed the three documents with secure tracking to the Fiduciary office on the same day.
